Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the website sacraw.com (the “Website”) and any services made available through it. The Website is operated by Sacraw Financial Corp. (“Sacraw Financial”, “we”, “us”, or “our”), a licensed insurance brokerage registered in the Province of Ontario, Canada (FSRA licence 37978M). By accessing or using the Website, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Website.

1. Acceptance of Terms

By accessing the Website or any part of it, you agree to be bound by and abide by these Terms, our Privacy Policy, and all applicable laws and regulations. You may use the Website only for lawful purposes, in accordance with these Terms, and in compliance with the laws of the jurisdiction where you reside. If you do not agree with any part of these Terms, you must not use this Website.

2. Modifications to the Terms

We may revise these Terms at any time by posting an updated version on the Website. Your continued use of the Website after a revision becomes effective constitutes acceptance of the updated Terms. You should review this page from time to time to stay informed of any changes. If a change to these Terms directly conflicts with a provision of an insurance policy or other written agreement between you and Sacraw Financial, the provision of the policy or agreement will govern.

3. Our Role as a Broker

Sacraw Financial is an insurance brokerage, not an insurer. We distribute travel insurance products on behalf of rated Canadian insurers. Policies sold through this Website are issued by Industrial Alliance Insurance and Financial Services Inc. and Industrial Alliance Pacific General Insurance Corporation (the insurers) and administered by North American Air Travel Insurance Agents Ltd. doing business as TuGo® (a licensed insurance broker in all Canadian provinces and territories). All claims are adjudicated by the insurer or its designated claims administrator, not by Sacraw Financial. The terms, conditions, exclusions, and limitations of any policy are set out in the policy wording issued by the insurer, which prevails over any information on this Website in the event of conflict.

4. Eligibility and Accuracy of Information

Our services are generally available to residents of Canada covered by a provincial or territorial health insurance plan, and to eligible visitors to Canada and international students in Canada. Eligibility is ultimately determined by the insurer under the applicable product terms.

You agree to provide accurate, current, and complete information when requesting quotes or purchasing insurance through the Website. Inaccurate, incomplete, or misleading information may result in a quote being invalid, a policy being voided, or a claim being denied. Pre-existing medical conditions must be disclosed accurately in accordance with the stability-period rules set out in the underwriter’s policy wording.

5. Insurance Products

All insurance products displayed or described on the Website are provided by our insurer partners. Coverage details, exclusions, limitations, and conditions are governed by the policy wording issued by the insurer at the time of purchase. In the event of any discrepancy or conflict between information on the Website and the official policy wording, the policy wording prevails. Availability and pricing of products may vary based on the traveller’s province of residence, age, trip details, and the underwriter’s then-current offering. Sacraw Financial reserves the right to modify or discontinue any product listing at any time.

6. Quotes and Pricing

Quotes provided through the Website are estimates based on the information you supply. Final premiums may differ if the underwriting team determines that different information applies to you (for example, medical questionnaire responses, exact dates of travel, or applicable sports-and-activities surcharges). Quotes are not binding commitments. A binding policy is issued only upon completion of the purchase flow, successful payment authorization, and acceptance by the insurer. As a licensed broker, Sacraw Financial may earn a commission from the insurer on policies sold. This commission is included in the premium quoted and does not result in any additional charge to you.

7. Limited Licence to Use the Website

We grant you a limited, revocable, non-exclusive, non-transferable licence to use the Website and its content for your own personal, non-commercial use and reference, subject to these Terms. All rights not expressly granted are reserved. You may not interfere with, disrupt, or create an undue burden on the Website or the networks or services connected to the Website.

8. Intellectual Property

The Website and all of its content — including text, graphics, logos, icons, images, audio, video, software, and the selection and arrangement thereof — are the property of Sacraw Financial or its licensors and are protected by Canadian and international copyright, trademark, and other intellectual-property laws. “Sacraw Financial”, the Sacraw Financial mark, and related designs are the trademarks of Sacraw Financial Corp. Third-party trademarks, including “TuGo®”, are the property of their respective owners and are used on this Website under licence or with permission. You may not copy, modify, reproduce, republish, distribute, display, or prepare derivative works from any content on the Website, except as expressly permitted in writing.

9. User Content and Acceptable Use

If you submit any content to the Website — such as feedback, comments, reviews, or questions — you grant Sacraw Financial a non-exclusive, royalty-free, worldwide, sub-licensable, perpetual licence to use, reproduce, adapt, and publish that content for purposes related to operating and improving the Website and our services. You represent that you have the right to grant this licence and that your content does not violate the rights of any third party.

You agree not to use the Website to: (a) submit content that is unlawful, threatening, defamatory, obscene, discriminatory, or otherwise objectionable; (b) impersonate any person or misrepresent your affiliation with any person or entity; (c) transmit viruses, malware, or any code designed to interrupt, damage, or limit the functionality of the Website or any computer; (d) attempt to gain unauthorized access to any portion of the Website, any account, or any connected system or network; (e) use automated tools to scrape, harvest, or extract information from the Website; or (f) use the Website for any commercial purpose not expressly authorized by us.

10. Links to Third-Party Sites

The Website may contain links to third-party websites, applications, or services — for example, the underwriter’s claims portal or policy-document hosting. These links are provided for convenience only and do not imply our endorsement or sponsorship. We are not responsible for the content, accuracy, privacy practices, or availability of third-party sites. Your use of third-party sites is at your own risk and subject to the terms and privacy policies of those sites.

11. Privacy and Personal Information

Your use of the Website is subject to our Privacy Policy, which describes how we collect, use, disclose, and protect personal information in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and other applicable Canadian privacy laws. By using the Website, you authorize Sacraw Financial to collect, use, and share information about you and your use of the Website as described in the Privacy Policy, including sharing with our insurer partners for the purposes of quoting, underwriting, issuing policies, and administering claims.

12. Cookies and Analytics

The Website uses cookies and similar technologies to operate correctly, remember your preferences, and understand how visitors use the Website. You can manage cookie preferences through the cookie consent banner presented on your first visit, or through your browser settings. Disabling cookies may limit the functionality of certain features. Details are set out in our Privacy Policy.

13. Disclaimer of Warranties

The Website and all content on it are provided on an “as is” and “as available” basis. To the fullest extent permitted by applicable law, Sacraw Financial makes no warranties, express or implied, and disclaims all warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Website will be uninterrupted or error-free, that defects will be corrected, or that the Website or the servers that make it available are free of viruses or other harmful components. Any information on the Website is provided for general information only and does not constitute personalized insurance, financial, medical, or legal advice.

14. Limitation of Liability

To the fullest extent permitted by applicable law, in no event will Sacraw Financial, its affiliates, directors, officers, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages — including damages for loss of profits, data, goodwill, or other intangible losses — arising out of or in connection with your access to or use of the Website or the inability to use the Website, regardless of the cause of action and whether or not we have been advised of the possibility of such damages. Our aggregate liability to you for all claims arising out of or related to the Website or these Terms will not exceed one hundred Canadian dollars (CAD $100). Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law.

15. Release and Indemnification

You release Sacraw Financial from all claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with your use of the Website, the content on the Website, any third-party sites accessed through the Website, or any transactions you enter into with third parties through the Website.

You agree to defend, indemnify, and hold harmless Sacraw Financial from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from: (a) your use of or access to the Website; (b) your breach of these Terms; (c) your violation of any law or the rights of any third party; or (d) any content you submit to the Website. These obligations survive termination of these Terms.

16. Refusal or Termination of Service

Sacraw Financial may, in its sole discretion and at any time, refuse service, limit or deny access to the Website, or terminate these Terms with you, with or without cause and with or without notice. If these Terms are terminated, you must cease all use of the Website immediately. Termination does not relieve you of obligations incurred before termination.

17. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. You and Sacraw Financial each irrevocably submit to the exclusive jurisdiction of the courts of the Province of Ontario in respect of any dispute arising out of or relating to these Terms or the Website, subject to any mandatory arbitration or consumer-protection rules that may apply.

18. Limitation Period

Any cause of action you may have with respect to the Website or these Terms must be commenced within one (1) year after the cause of action arose; otherwise, the cause of action is permanently barred, except where a longer period is required by applicable law and cannot be contractually shortened.

19. General

Severability. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

No waiver. Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.

No agency. Nothing in these Terms creates an agency, partnership, joint venture, or employment relationship between you and Sacraw Financial.

Entire agreement. These Terms, together with our Privacy Policy and any policy documents issued by an insurer in connection with your purchase, constitute the entire agreement between you and Sacraw Financial regarding the Website.

Translations. These Terms were originally drafted in English. If we make a French translation available, it is provided for convenience only; the English version governs in the event of any conflict.
